Subject: Restricted Identifiers in Electronically Filed Documents
This message is being sent to all individuals with a registered email address in the Minnesota Judicial Branch eFile and eServe (eFS) program.

Subject: Restricted Identifiers in Electronically Filed Documents
Documents eFiled with the court and classified as public must not include restricted identifiers (social security, employer identification, and financial account numbers, whether full or partial).  Court rules place the responsibility for removing confidential information on the filing parties and provide a method for redacting restricted identifiers.
Failure to comply with this requirement may result in legal and ethical liability for the filer, in addition to court imposed sanctions, including costs necessary to prepare an appropriate document for filing. (Gen. R. Prac. 11.04.)
Restricted identifiers must be redacted from public documents and reported separately on 11.1 Confidential Information Form.
Filers should submit the redacted document separately and classify it as “public”, then submit Form 11.1 and classify it as “confidential.”  Use the Confidential Information Form 11.1 personal information filing code when eFiling Form 11.1.
Rule 11 also requires that financial source information (income tax returns, W-2 forms and schedules, wage stubs, credit card statements, financial institution statements, check registers, and other financial information deemed financial source documents by court order) be redacted and submitted accompanied by a Sealed Financial Source Documents Form 11.2.  
Filers should list financial source documents on Form 11.2, then submit Form 11.2 classified as “public”. Separately submit the financial source documents classified as “confidential.”
Financial source documents submitted with the appropriate Form 11.2 are not accessible to the public except when admitted into evidence in a testimonial hearing or trial or in a motion challenge as provided under rule 11.05.

The purpose of this message is to remind you of three key changes, effective September 16, 2013. 
1.       Searchable PDF Document Format Requirement – All Case Types
Effective September 16, 2013, all eFiled documents, whether in mandatory or voluntary case types, must be submitted in a text-searchable PDF format, or, where applicable, non-text-searchable PDF format. (See: Minnesota General Rule of Practice 14.03(a).)

2.  30-Day Limit on Access to Documents in the eFiling and eService system
As of September 16, 2013, all documents filed through the eFile and eServe system will only be available for viewing for 30 days after the date of acceptance or rejection by the court. This is true for all versions of the document: original, transmitted, and stamped. Also, as of September 16, 2013, all document links included in eService electronic mail messages will be active for 30 days after the date of the electronic mail message.
After 30 days:
  • The document image will no longer be available.
  • The document link contained in eService electronic mail messages will no longer be active.
  • The system will continue to show a record of the filing and service, but not the document image.
  • Document images may be retrieved at the courthouse from court administration.
Beginning on October 16, 2013:
  • All documents that were accepted or rejected more than 30 days prior will no longer be available in the system, and
  • All document links in eService electronic mail messages dated more than 30 days prior will be inactive.
3. Mandatory eFile and eServe Expands
Effective September 16, 2013, eFiling and eService will be mandatory for all general civil cases and family court cases in district courts in the following counties: Cass, Clay, Cook, Dakota, Faribault, Kandiyohi, Lake, Morrison, and Washington.  eFiling and eService in these cases have been mandatory in the district courts in Hennepin and Ramsey counties since September 1, 2012. 
Attorneys representing parties in these cases, and government attorneys appearing in such cases, must eFile and eServe documents in the 11 counties listed above as required under the Minnesota General Rules of Practice and the Minnesota Rules of Civil Procedure
Civil cases include Examiner of Title cases, but exclude Probate/Mental Health and Conciliation Court case types.
Family court cases include Annulments, Custody, Dissolutions with Children, Dissolutions without Children, Domestic Abuse, Family Other, Legal Separation, Paternity, Separate Maintenance, Summary Dissolution, Support, and Transfers of Legal Custody. 
Attorneys and Government Agencies not yet registered can get started here with eFile and eServe.

If the electronic filing system is unavailable, please check back periodically.  If system unavailability prevents you from electronic filing where mandatory, an exception may be requested to the mandatory eFiling requirement under Minnesota General Rule of Practice 14.01(d); 14.01(f)(1)
