Supreme Court Adopts Frivolous Litigation Rule


ST. PAUL, MN (Sept. 2, 1999) - Today the Minnesota Supreme Court issued an order amending the General Rules of Practice for the District Courts to include a new rule regarding frivolous litigation. 

The rule establishes a hearing process and factors for the court to consider when dealing with claims of frivolous litigation.

The rule was originally proposed by the Conference of Chief Judges, the governing and policy-making body of the state’s 257 District Court Judges.  The Supreme Court Advisory Committee on the General Rules of Practice for District Courts recommended adoption of the Conference of Chief Judges’ proposal, with minor modifications.  Following the recommendation, the Supreme Court held a public hearing on the proposed amendments.  September 1, 1999, Chief Justice Kathleen A. Blatz signed the court order promulgating the new rule, which is effective immediately.
